Introduction and Agreement

Legal Framework and Compliance

Your use of insightsAI is governed by, but not limited to, the following U.S. federal laws and regulations:

• Computer Fraud and Abuse Act (CFAA, 18 U.S.C. §1030): You are prohibited from unauthorized access, exceeding authorized access, or otherwise compromising insightsAI's systems and data. Violations of CFAA could result in criminal penalties, civil liability, and immediate account termination.
• Digital Millennium Copyright Act (DMCA, 17 U.S.C. §512): You must respect copyright and intellectual property rights. insightsAI complies with the DMCA and will promptly respond to legitimate takedown notices concerning copyrighted material.
• Stored Communications Act (18 U.S.C. §2701): You must not unlawfully access stored communications or personal data maintained within insightsAI's systems. Any breaches or unauthorized disclosures will result in immediate legal action.

Data Protection and Privacy Compliance

We adhere strictly to applicable data protection laws, including but not limited to:

• General Data Protection Regulation (GDPR): Although primarily an EU law, GDPR applies when processing data of EU residents. insightsAI is committed to protecting user privacy, maintaining transparency, and allowing users to control their personal data.
• California Consumer Privacy Act (CCPA): Users residing in California are entitled to specific privacy rights under the CCPA. insightsAI does not sell, lease, or rent user data and will respond to valid requests to access or delete personal data as stipulated by law.

User Responsibilities and Restrictions

In compliance with relevant legal standards, you agree to the following:

• Not to upload or distribute harmful, defamatory, obscene, or otherwise illegal content as prohibited by federal and state law.
• Comply with all applicable export control laws, including but not limited to the Export Administration Regulations (EAR) and International Traffic in Arms Regulations (ITAR).
• Refrain from activities such as spamming, phishing, hacking, unauthorized data scraping, or any conduct that might violate laws including but not limited to the CAN-SPAM Act and Telephone Consumer Protection Act (TCPA).

Security and Malicious Activity

insightsAI explicitly disclaims responsibility for malicious or criminal acts committed by users. Under the Computer Fraud and Abuse Act (CFAA), we reserve the right to immediately suspend or terminate your account and report any suspicious activities to appropriate law enforcement authorities. Additionally, insightsAI reserves the right to initiate legal proceedings against users who breach security protocols or engage in unlawful activities.

Intellectual Property Rights

insightsAI respects intellectual property laws as set forth by Title 17 of the United States Code. All software, methodologies, and trademarks used in our platform are protected intellectual property. You may not copy, modify, or distribute insightsAI technology without explicit written permission.

Liability and Warranty Disclaimers

Consistent with the Uniform Commercial Code (UCC), insightsAI provides its services on an "as-is" and "as available" basis without warranties of any kind, express or implied. insightsAI disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permissible under applicable law.

Our liability is strictly limited in accordance with established principles of contract law. We are not responsible for indirect, consequential, incidental, or punitive damages resulting from your use of insightsAI. Our total liability shall never exceed the greater of $100 USD or the total fees paid by you in the preceding twelve months.

Billing and Payments

Billing practices comply with applicable financial regulations, including the Truth in Lending Act (TILA) for transparency in billing cycles and payment terms. insightsAI provides clear subscription terms, billing cycles, and refund policies. All fees are billed in advance, are non-refundable unless required by law, and changes to subscription plans become effective in the subsequent billing period.

Termination of Services

Either party may terminate this agreement at any time. insightsAI reserves the right to terminate or suspend your account at any time, without prior notice, for any reason or no reason, in our sole discretion. Upon termination, insightsAI will promptly delete your data in compliance with applicable privacy laws. Certain obligations—including data privacy, indemnification, and liability—will survive termination of these Terms.

Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the State of Florida, USA, without regard to conflicts-of-law principles. Users agree to submit to the jurisdiction of the state and federal courts in Florida for any disputes arising under these Terms.

Indemnification

You agree to indemnify and hold harmless insightsAI and its affiliates, employees, officers, directors, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms, your misuse of the services, or your violation of any applicable laws.

Final Acceptance and Entire Agreement

These Terms constitute the entire legal agreement between insightsAI and you, superseding any prior agreements. Your continued use of insightsAI explicitly confirms your acceptance of all terms described herein.

Amendments

insightsAI reserves the right to amend these Terms at any time, posting updates directly within the application. Continued use after amendments constitutes acceptance of the revised Terms.
